CONTRACT SPECIFICATION
6. Contract description
The city of Olomouc, where the Works would be executed, is located in the
eastern part of the Czech republic (Middle Moravia) and ranks among the
six biggest cities. The city has a total population of around 105,000.
The project consists of the following four sub-components, related either
to construction of additions to the sewer network or
rehabilitation/reconstruction of existing sewers:
(1) Slavonín - Nemilany Sewer System
The part of the Project concerns Slavonín and Nemilany area and is
aimed at a new sewer system construction. There is both combined and
separate (sewerage and storm water) sewer system applied in Slavonín
of the total length of 8658 m. The sewer system in Nemilany is
combined only, of the total length of 7319 m.
Sewers would form a sewer network. Because of inconvenient local
altitude conditions several sewerage pumping stations would be
installed. Storm water drainage consists mainly of separate pipes
which are led directly to the local minor stream Nemilanka.
The Project also involves the public part of the sewer connections.
(2) Sewer «G» Upgrading
Two parts would be upgraded:
The first part of the rehabilitation of the sewer «G» has to be
realised by an unexcavation method using a drilling machine with
2000 mm buckler. Inner lining would be applied. The length of the
first part is 892,50 m.
The second part of the rehabilitation of the sewer «G» follows the
first part and has to be also realised by a drilling machine with
2000 mm buckler. Inner lining would be applied. The length of the
second part is 853 m.
(3) Sewer «F» Upgrading
The sewer «F» upgrading is designed as an excavation, except for the
parts along the river Bystřice and under the Divišova street (tram
railway crossing) where it would be thrusted by a gallery of
1200/1700 mm. The Works include public connections. The length of
the sewer is 2,012 m.
(4) Sewer «BXVIII»
Designed combined sewer would collect wastewater system of the city
parts of Hejčín, Řepčín and Neředín. The sewer of length 1918 m
would be constructed by classical methods. The trunk sewer profiles
would be DN 500 - DN 1400.
The Works Contract shall be in accordance with the rules of FIDIC «Red
Book»- Conditions of Contract for Construction for building and
engineering works designed by the employer, First Edition 1999.
7. Number and titles of Lots
One single Contract.
CONDITIONS OF PARTICIPATION
8. Eligibility and rule of origin
Participation is open on equal terms to all natural and legal persons
[participating either individually or in a grouping (consortium) of
tenderers] of the Member States and the countries and territories of the
regions covered and/or authorised by the Regulation or other specific
instruments applicable to the programme under which the contract is
financed (see also item 21 below). All goods provided for this contract
must originate in these countries.
9. Grounds for exclusion
Tenderers must provide a declaration that they are not in any of the
situations listed in Section 2.3 of the Manual of Instructions for
External Relations contracts (available from the following Internet
address: http://europa.eu.int/comm/europeaid/home_en.htm).
10. Number of tenders
Tenderers (including firms within the same legal group, other members of
the same consortium, and sub-contractors) may submit only one tender for
all four Lots. Tenders for parts of Works or/and of a Lot will not be
considered. Tenderers may not provide a tender for a variant solution in
addition to their tender for the works required in the tender dossier.
11. Tender guarantee
Tenderers must provide a tender guarantee of EUR 90,000 when submitting
their tender. This guarantee will be released to unsuccessful tenderers
once the tender procedure has been completed and to the successful
tenderer(s) upon signature of the contract by all parties.
12. Performance guarantee
The successful tenderer will be requested to provide a performance
guarantee of 10% of the contract value in euro when countersigning the
contract. This must be delivered within 30 days after receipt by the
tenderer of the contract signed by the Contracting Authority. If the
selected tenderer fails to provide such a guarantee within this period,
the contract will be void and a new contract may be drawn up and sent to
the tenderer which has submitted the next lowest, compliant tender.
13. Information meeting and/or site visit
No information meeting is planned.
14. Tender validity
Tenders must remain valid for a period of 90 days after the deadline for
submission of tenders.
15. Maximum delivery period
The Contractor must observe the deadline for start of the operation of
the whole completed Works, which is 30th of June 2006.
Nevertheless, the actual Commencement Date has no impact on the required
deadline for start of the operation of the completed Works.
SELECTION AND AWARD CRITERIA
16. Selection criteria
16.1 Economic and Financial Capacity of the Candidate(s)
a) He shall be a registred company capable of carrying out the
specified Works
b) The average annual turnovers in the past 3 years shall be at least
30,000,000 EURO. These turnovers must be demonstrated as a
performance carried out at least 70 % by Tenderer's own means.
c) If he is a sole Tenderer or a Joint Venture/Consortium he must
have access to credit facilities adequate to assure the required
cashflow for the duration of the Contract. In any case the credit
amount must exceed 4,000,000 EURO.
16.2 Technical and Professsional Capacity of the Candidate(s)
a) Evidence of successful experience as the sole Contractor in
construction of at least 2 projects of the same nature and
complexity comparable to the tendered works during last 10 years.
b) If he is a sole Tenderer (i.e. he may have subcontractors, but he
is not a partner in a Joint Venture/Consortium for the purposes of
the Tender) he shall carry out at least 70 % of the Contract Works
by his own means, defined as meaning that he must have the
equipment, materials, human and financial resources necessary to
enable him to carry out this percentage of the Contract.
c) If he is the Leading Partner in a Joint Venture/Consortium he
shall have the ability to carry out at least 50 % of the Contract
Works by his own means.
d) If he is another partner in a Joint Venture/Consortium (i.e. not
the Leading Partner) he shall carry out at least 10 % of the
Contract Works by his own means.
e) All his key personnel shall have at least 10 years of adequate
experience and proven qualifications relevant to works of a similar
nature to this project.

Olomouc,
which excludes courier delivery.
The tender dossier will be available upon written request, preferably by
facsmile No +42027936597. The written request must be delivered within 10
calendar days after issuing of this Procurement Notice in OJEC. The
tender dossier will be available at the above address from 09.00 to 12.00
a.m., after 24 calendar days following the issuing of this Procurement
Notice in OJEC.
In the case that the written request is not delivered within 10 calendar
days after issuing of this Procurement Notice the tender dossier will be
available after 25 days after the written request has been delivered.
Payment for the Tender Dossier shall be made to the Statutory City of
Olomouc, bank Česká Spořitelna, bank account No.19-1801731369/0800,VS
23216126.
It is also available for inspection at the premises of the Implementing
Agency. Tenders must be submitted using the standard tender form included
in the tender dossier, whose format and instructions must be strictly
observed.

Implementing Agency must reply to all tenderers' questions at least 11
days before the deadline for submission of tenders.

with acknowledgement of receipt or hand-delivered against receipt signed
by a representative of Implementing Agency.
Any tender received after this deadline will not be considered.
20. Tender opening session
Tenders shall be opened in public session on 30 March 2004 at 10.00 a.m.
